1. Acceptance of Terms

By accessing and using Zapfile ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Zapfile is a secure file sharing service that allows users to upload, store, and share files through encrypted links. We provide:

  • Secure file upload and storage
  • End-to-end encryption
  • Time-limited download links
  • Usage analytics and management tools
  • Multiple subscription tiers

3. Prohibited Content and Activities

You are strictly prohibited from uploading, sharing, or distributing:

  • Malware: Viruses, trojans, worms, spyware, or any malicious code
  • Illegal Content: Content that violates any applicable laws or regulations
  • Copyrighted Material: Content that infringes on intellectual property rights without proper authorization
  • Executable Files: .exe, .bat, .cmd, .scr, .com, .pif, .msi, .dll, .jar, .vbs, .js, .ps1 files
  • Phishing Materials: Content designed to steal credentials or personal information
  • Spam: Unsolicited bulk communications or promotional material
  • Harassment Content: Material intended to harass, threaten, or harm others
  • Adult Content: Pornographic, sexually explicit, or age-inappropriate material

Anonymous uploads are subject to additional restrictions:

  • 100MB file size limit
  • Rate limiting: 10 uploads per hour, 50 per day
  • 24-hour retention period (then deleted)
  • Single download per file
  • Enhanced security scanning
  • Automatic content analysis
  • Download warnings for recipients

4. Security Measures and Monitoring

To protect our users and maintain service quality, we implement:

  • Automated Scanning: All files are scanned for malware and suspicious content
  • Rate Limiting: Upload limits based on account type and IP reputation
  • IP Reputation System: Tracking and scoring of suspicious activities
  • File Type Validation: Restriction of potentially dangerous file types
  • Content Analysis: Behavioral analysis of uploaded content
  • Download Monitoring: Tracking of download patterns and abuse reports

5. Enforcement and Penalties

Violations of these terms may result in:

  • Immediate File Removal: Removal of violating content without notice
  • IP Address Blocking: Temporary or permanent blocking of access
  • Account Suspension: Suspension or termination of user accounts
  • Reputation Penalties: Reduced privileges and increased restrictions
  • Law Enforcement Referral: Reporting of illegal activities to authorities
  • Legal Action: Pursuit of civil or criminal remedies where applicable

We maintain logs for security and legal compliance purposes, including:

  • IP addresses and upload timestamps
  • File metadata and content analysis results
  • Download activity and user interactions
  • Abuse reports and enforcement actions

6. Reporting Abuse

If you encounter suspicious, malicious, or inappropriate content:

  • Report immediately to help@zapfile.app
  • Include the file download link and description of the issue
  • Do not download or execute suspicious files
  • We investigate all reports within 24 hours

7. Account Registration

To use certain features of our service, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Acceptable Use Policy

Permitted Uses

You may use our service to upload and share files for legitimate purposes including:

  • Personal file sharing and backup
  • Business document sharing
  • Creative content distribution
  • Educational material sharing

Prohibited Uses

You agree NOT to use our service to:

  • Upload, store, or share copyrighted material without permission
  • Distribute malware, viruses, or malicious code
  • Share illegal, harmful, or offensive content
  • Violate any applicable laws or regulations
  • Harass, abuse, or harm others
  • Spam or send unsolicited communications
  • Attempt to reverse engineer or compromise our systems
  • Use the service for cryptocurrency mining or illegal activities

5. Storage and File Limits

Plan Limits

  • Free Plan: 1GB storage, 3-day expiration
  • Pro Plan: 15GB storage, 1-year expiration
  • Max Plan: 100GB storage, 1-year expiration

Exceeding your plan limits may result in service restrictions. Files that exceed expiration dates will be automatically deleted.

6. Payment and Subscriptions

  • Subscription fees are billed in advance
  • All payments are non-refundable unless required by law
  • We may change pricing with 30 days notice
  • Failure to pay may result in account suspension
  • You may cancel your subscription at any time

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy. By using our service, you consent to the collection and use of information as outlined in our Privacy Policy.

8. Intellectual Property

  • You retain ownership of files you upload
  • You grant us license to store and serve your files
  • Our service and technology remain our property
  • You must respect others' intellectual property rights

9. Service Availability

We strive to maintain high service availability but cannot guarantee uninterrupted access. We may suspend service for maintenance, security, or legal reasons. We are not liable for any losses due to service interruptions.

10. Termination

We may terminate or suspend your account at any time for:

  • Violation of these terms
  • Illegal or harmful activity
  • Non-payment of fees
  • Suspected security breach

Upon termination, your access will be revoked and files may be deleted.

11. Limitation of Liability

To the maximum extent permitted by law, Zapfile shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our service. Our total liability shall not exceed the amount you paid for the service in the preceding 12 months.

12. Disclaimer of Warranties

Our service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or service notifications. Continued use of the service constitutes acceptance of updated terms.
